1. Introduction & Overview
1.1 VIMAN EDTECH (hereinafter referred to as “VIMAN EDTECH,” “Company,” “We,” “Us,” or “Our”) is an educational technology organization operating from its office at VY Campus, Samastipur, Bihar - 848505, India.
1.2 These Terms and Conditions (hereinafter referred to as “Terms” or “T&C”) govern your access to and use of our official website http://www.vimanedtech.com/, mobile applications, digital learning portals, and allied services (collectively referred to as the “Platform”).
1.3 Any student under the age of 18 (hereinafter referred to as the “Student”) must access the Platform only under the guidance, consent, and active supervision of a parent or legal guardian. By accessing or subscribing to our Platform and Services for a Student, you represent that you are the parent or legal guardian (hereinafter referred to as the “Parent”) of such Student, or an individual user above 18 years of age (hereinafter referred to as the “User”). The Parent and adult User are collectively referred to herein as “you” or “your.”
1.4 Electronic Record: These Terms constitute an electronic record generated by a computer system in accordance with the provisions of the Information Technology Act, 2000 and rules made thereunder, as amended. This electronic record does not require physical or digital signatures.
1.5 Acceptance: By visiting, accessing, or using our Platform and enrolling in any course or session, you agree to be bound by these Terms, our Privacy Policy, and all applicable rules and guidelines. If you do not agree with any part of these Terms, you must immediately discontinue using the Platform and refrain from enrolling in our programs.
1.6 Amendments: We reserve the right to revise, update, or modify these Terms at any time without prior notice. The updated version will be posted on the Platform with a revised date. Your continued use of the Platform after changes are posted constitutes your binding acceptance of such modifications.
2. Description of Services & Usage Rules
2.1 Educational Services: VIMAN EDTECH provides specialized speed-math and conceptual learning curricula (such as UKG-1, Grade 2-3, Grade 4-6, Grade 7-8, and other speed-math modules) delivered via live virtual sessions, interactive exercises, evaluation assessments, and related educational materials (collectively, the “Services”).
2.2 Virtual Learning Environment: All live sessions and course activities take place digitally via the Platform. VIMAN EDTECH does not operate physical learning centers or provide offline classroom training unless explicitly stated in writing.
2.3 Personal, Non-Commercial Use: The Platform and Services are granted strictly for your personal, non-commercial, educational use. You agree not to copy, sell, resell, lease, distribute, or exploit any portion of our Platform, curriculum, or live session content for commercial purposes.
2.4 Prohibited Activities: You expressly agree that you shall not:
- Decompile, reverse engineer, disassemble, or extract source code from any software or content on the Platform.
- Reproduce, retransmit, broadcast, mirror, frame, or create derivative works from our curriculum, session recordings, or learning materials.
- Remove, alter, or obscure any copyright, trademark, or proprietary notices from our digital or printed content.
- Use the Platform in any manner that is unlawful, fraudulent, defamatory, harmful, or disruptive to other users or trainers.
- Share account credentials with third parties or allow multiple unauthorized devices to access live sessions.
3. Account Registration & Security
3.1 Registration Requirements: To enroll a Student or access Services, the Parent or adult User must create an account on the Platform by providing valid credentials, including full name, email address, mobile phone number, residential address, and student academic details.
3.2 Account Uniqueness: An account can be created using only one unique email address and verified phone number.
3.3 Account Confidentiality: You are solely responsible for maintaining the confidentiality of your login credentials (username and password). You accept full responsibility for all activities occurring under your account.
3.4 Unauthorized Access: If you detect or suspect any unauthorized access to or breach of your account, you must notify VIMAN EDTECH immediately at support@vimanedtech.com. VIMAN EDTECH will not be liable for any losses caused by unauthorized account usage outside our reasonable control.
3.5 Account Suspension: If an account is found logged into multiple unauthorized locations or devices concurrently, or is being used in violation of these Terms, VIMAN EDTECH reserves the right to suspend or terminate the account immediately without refund.
4. Parental Responsibility & Live Session Rules
4.1 Parental Supervision:The Parent agrees to supervise the Student's attendance, conduct, and participation during online live sessions. The Parent assumes full liability for all actions performed by the Student on the Platform.
4.2 Session Recording Permission: You explicitly grant permission to VIMAN EDTECH to record, screenshot, and archive live online sessions, including student audio, video, and text interactions, for:
- Quality assurance, trainer evaluation, and pedagogical improvements.
- Reviewing attendance and student academic evaluation.
4.3 Classroom Decorum: Students and Parents are expected to maintain respect, discipline, and decorum during live classes. Disruptive behavior, inappropriate language, or harassment toward trainers or fellow students may result in immediate expulsion from the session and temporary or permanent account suspension without refund.
5. Curriculum, Credits, & Batch Allocations
5.1 Curriculum Structure: VIMAN EDTECH programs are structured across designated sections and sessions (e.g., UKG-1 with 80 total sessions across 6 sections; Grade 2-3 with 80 sessions across 6 sections; etc.). VIMAN EDTECH reserves the right to refine, update, or reorganize course modules to enhance learning outcomes.
5.2 Credit-Based System:
- Services operate on a credit-based enrollment system where 1 Credit = 1 Live Session.
- Credits are purchased in predetermined course packages as indicated on the purchase invoice.
- Credits are deducted upon the scheduling and completion of each class session in the assigned batch, regardless of student attendance, unless an official pause or leave request was approved in advance under Section 7.
- Credits are non-transferable between students or accounts.
- Credits carry a fixed validity period corresponding to the batch schedule duration (Expiry Date). Unused credits expire automatically after the Expiry Date.
5.3 Batch Allocation:
- Upon enrollment, VIMAN EDTECH requires up to 14 days to allocate a suitable batch based on student grade level, language preference, and slot availability.
- Requests for custom or non-standard batch timings, specific days, or specific trainers are subject to availability and may attract an additional batch allocation/customization fee as determined by VIMAN EDTECH.
5.4 Batch Change Requests:
- Any request to alter class timings, session days, time zone, or trainer after initial batch allocation constitutes a Batch Change Request.
- Batch Change Requests must be submitted in writing to customer support at least 14 days in advance and are subject to slot availability and an administrative fee (up to ₹5,000 / $100 depending on region).
6. Technical Compatibility & Requirements
6.1 Hardware & Internet: The User is solely responsible for obtaining and maintaining compatible computer hardware, mobile/tablet devices, webcams, microphones, and high-speed internet connectivity required to participate in live sessions.
6.2 System Disruption: VIMAN EDTECH is not responsible for missed classes or poor video/audio quality resulting from user-side connectivity issues, hardware failures, or local power outages.
7. Batch Pause Policy
7.1 Eligibility: A Student enrolled in a course with a duration exceeding 30 sessions may request a temporary Batch Pause under genuine circumstances (such as medical emergencies, school examinations, or family travel).
7.2 Pause Limits:
- Maximum pause duration permitted is 30 calendar days.
- A pause facility can be availed a maximum of 1 to 2 times per program lifetime, depending on program length.
- Credit deductions are temporarily suspended during an approved pause period exceeding 15 days.
7.3 Resumption:
- Upon resumption from a Batch Pause, VIMAN EDTECH requires up to 15 business days to assign a new active batch.
- VIMAN EDTECH does not guarantee the same trainer, batch schedule, or slot timing upon resumption from a pause.
8. Payment, Fees, & Automatic Renewals
8.1 Fee Payment: All course fees, credit purchases, and registration charges must be paid upfront through approved payment methods on the Platform.
8.2 Third-Party Payment Gateways: Payments are processed securely via external payment gateway partners (such as CCAvenue, Razorpay, PayU, or Stripe). You agree to abide by the terms and privacy conditions of such third-party payment processors. VIMAN EDTECH does not store card numbers or CVVs on its servers.
8.3 Recurring Payments: If you enroll in a recurring subscription or automated installment plan, recurring deductions will occur automatically on designated billing dates. Subscriptions must be canceled in writing at least 7 business days prior to the next billing date to avoid automatic deduction.
9. Refund & Cancellation Policy
9.1 Refund Conditions: Refund requests for credit purchases or course fees will be evaluated only when all of the following conditions are met:
- A written refund request is submitted to support@vimanedtech.com within the eligible refund window specified at the time of enrollment.
- The Student has completed a minimum of 30 sessions/credits in the course.
- The Student has maintained a minimum 80% attendance rate across all scheduled sessions within consumed credits.
9.2 Non-Refundable Circumstances: Refunds will not be granted for:
- Personal schedule conflicts, change of mind, or change of residential location.
- Unmet student expectations that fall outside the defined curriculum goals.
- Accounts terminated due to violation of classroom decorum or these Terms.
- Sessions missed due to student no-shows or user-side technical failures.
9.3 Processing Refunds: Approved refunds will be processed back to the original payment source after deducting administrative and processing fees within 14–21 business days.
10. Intellectual Property Rights
10.1 Exclusive Ownership: All content, trade secrets, teaching methodologies, speed-math tricks, proprietary formulas, logos, branding, trademarks, session slide decks, video lessons, audio recordings, tests, and printed workbooks on the Platform belong exclusively to VIMAN EDTECH.
10.2 Prohibition of Recording: You are strictly prohibited from screen recording, audio recording, photographing, downloading, uploading, or distributing any live session, trainer video, or platform material without explicit written permission from VIMAN EDTECH.
10.3 Infringement Liability: Unauthorized use or distribution of VIMAN EDTECH’s intellectual property constitutes a legal breach and infringement under Indian copyright and trademark laws, subjecting the offender to immediate account termination, civil claims, and criminal prosecution.
10.4 User Submissions: Any feedback, testimonials, comments, student project submissions, or reviews submitted to VIMAN EDTECH become the non-exclusive, royalty-free property of VIMAN EDTECH for promotional and educational usage across media channels.
11. Confidentiality
11.1 You agree to maintain strict confidentiality regarding all proprietary course materials, platform software, curriculum methodologies, and trade secrets disclosed to you by VIMAN EDTECH.
11.2 You shall not share, publish, or leak course materials to third-party institutions, online forums, or competitors.
12. Limitation of Liability & Disclaimers
12.1 No Educational Guarantee: VIMAN EDTECH’s programs are designed to supplement school education and enhance mathematical aptitude. While our methods are proven, we do not guarantee specific academic grades, competitive exam ranks, or school results.
12.2 Platform Availability: Services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied. VIMAN EDTECH does not warrant that the Platform will be uninterrupted, error-free, or free from server outages or cyber threats.
12.3 Liability Cap: In no event shall VIMAN EDTECH, its founders, directors, employees, or trainers be liable for any indirect, incidental, special, consequential, or punitive damages. VIMAN EDTECH’s total aggregate liability for any claim under these Terms shall be strictly limited to the actual course fee paid by you to VIMAN EDTECH in the preceding three (3) months.
13. Indemnification
You agree to defend, indemnify, and hold harmless VIMAN EDTECH, its founders (including Vicky Kumar), officers, directors, employees, trainers, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debts (including attorney’s fees) arising from:
- Your or your Student’s use or misuse of the Platform.
- Any violation of these Terms or applicable laws by you or your Student.
- Any infringement of third-party intellectual property or privacy rights caused by your account.

15. Governing Law, Jurisdiction, & Dispute Resolution
15.1 Governing Law: These Terms and any dispute arising out of or related to your use of the Platform shall be governed by and construed in accordance with the laws of India.
15.2 Jurisdiction: Subject to arbitration below, any legal suit, action, or proceeding arising out of these Terms shall be instituted exclusively in the competent courts located in Samastipur / Patna, Bihar, India.
15.3 Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms, including the breach, termination, or invalidity thereof, shall be referred to and finally resolved by binding Arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended).
- The arbitral tribunal shall consist of a Sole Arbitrator appointed exclusively by VIMAN EDTECH.
- The seat and venue of arbitration shall be Samastipur, Bihar, India.
- The language of arbitration proceedings shall be English.
